1. Who we are

This policy is published by the website delesalleyachts.com ("the site", "we", "us"). The site decides why and how the personal data described in this policy is processed.

For any question about your personal data, write to us at info@delesalleyachts.com.

2. What data we collect

Data you give us in the inquiry and contact forms on the site, by e-mail or through messengers:

  • your name;
  • your e-mail address and/or phone number;
  • messenger type and ID (WhatsApp, Telegram), if you choose to be contacted there;
  • the details of your request: the yacht you are interested in, dates and number of guests or a convenient time to contact you, and your message;
  • your consent to this policy (the tick box in the form).

Data collected automatically when you use the site:

  • technical data: IP address, browser and device type, pages visited and time of visit;
  • cookies (see section 6);
  • your favourite yachts and chosen currency (EUR/USD) in the yacht catalog. These are kept only in your own browser and are not sent to us.

We do not ask for special categories of data (such as health or religion). Please do not include them in your messages.

3. Why we use your data and on what legal basis

We need your name and an e-mail address or phone number to answer you. Without them we cannot process your request.

4. Who processes your data

We do not sell your personal data. It is processed only for the purposes above:

  • website and forms: the site and its forms run on Tilda Publishing;
  • web analytics: Yandex Metrica (Yandex LLC, Russia), with cookies, only if you accept analytics cookies;
  • our customer database (CRM): inquiries are stored in our own CRM on a server of OVH in France (EU);
  • e-mail: notifications about new inquiries are sent through our e-mail service; our mailbox info@delesalleyachts.com is hosted by an e-mail hosting provider in Spain (sadmin.es);
  • messengers: if you contact us via WhatsApp or Telegram, their own privacy policies apply;
  • exchange rates: when you switch prices to USD in the catalog, your browser requests the rate directly from open.er-api.com, which receives your IP address; no other data is sent;
  • yacht owners and their representatives: when you ask us to check availability, arrange a charter or a viewing, we pass on only the details needed for that request;
  • authorities, when the law requires it.

5. Transfers outside the European Economic Area

Yandex Metrica is operated by Yandex LLC in Russia, outside the European Economic Area, in a country without an EU adequacy decision. Analytics data is transferred there only if you accept analytics cookies (GDPR Art. 49(1)(a)).

If the yacht you ask about is managed outside the European Economic Area, we pass on the details needed for your request because the transfer is necessary for the contract you asked for (GDPR Art. 49(1)(b)).

6. Cookies

The site uses:

  • necessary cookies set by the website platform (Tilda) so that the site and its forms work;
  • analytics cookies set by Yandex Metrica, only after you accept them in the cookie banner.

You can change your choice or delete cookies at any time in your browser settings.

7. How long we keep your data

  • Inquiries and our correspondence with you: no longer than 3 years after our last contact, unless the law requires us to keep them longer.
  • Analytics data: for the retention period of Yandex Metrica.
  • Favourite yachts and currency in your browser: until you clear your browser data.

8. Your rights

Under the GDPR you have the right to:

  • access your personal data and receive a copy;
  • rectify inaccurate or incomplete data;
  • erase your data;
  • restrict processing;
  • data portability — receive the data you gave us in a machine-readable format;
  • object to processing based on our legitimate interest;
  • withdraw your consent at any time, without affecting processing carried out before the withdrawal.

To use any of these rights, write to info@delesalleyachts.com. We will reply within one month. We may ask you to confirm your identity.

You also have the right to lodge a complaint with a data protection supervisory authority, in particular in the EU Member State where you live, work or where you believe your rights were infringed.

9. Security

The site and our CRM are accessed over encrypted connections (HTTPS), and access to the CRM is limited to our staff and protected by passwords.

10. Children

Our services are intended for adults. We do not knowingly collect data from children under 16.

11. Changes to this policy

We may update this policy. The current version is always published on this page with the date of its last update.
